Bye-Bye OECD
Brazil has been attempting to be allowed to join the OECD since 2017 and suffered a setback recently when Congress began to deliberate a new law against the Abuse of Authority (by judges and prosecutors). Immediately, OECD member nations affirmed “if this is passed, Brazil will not be allowed to join the OECD”.
Now this situation has gotten much worse – thanks to a monocratic injunction issued by STF President – Dias Toffoli - on Tuesday, 16th July. In response to a request by the lawyers of now Senator Flávio Bolsonaro (PSL-RJ) cancel the investigation by state prosecutors in Rio of “atypical” financial movements by then state deputy Flávio Bolsonaro and his staff flagged by COAF, Toffoli extended his injunction to include ALL criminal investigations in Brazil – that such investigations could only proceed via a judicial authorization.
This decision in fact closed down ALL criminal investigations in Brazil è Lava Jato, organized crime activities, drug traffic, arms traffic, money laundering, corruption, money changers (doleiros) etc by federal and state investigators è COAF, public prosecutors, SRF (federal revenue service and even the Central Bank. Really, this is a great boon for criminal activities, including corruption practiced by political parties and politicians
In effect, this decision contradicts Brazil’s international commitments with other nations to combat all these criminal activities AND will now become another impediment for Brazil to join the OECD.
This monocratic decision by Toffoli contradicts decisions taken by the STF since 2016 and annuls the law that obliges COAF to pass on this information to the PGR, Federal Police, SRF, TCU and Central Bank.
The full STF will only deliberate this decision in November!!
